Alleged Violations against Alpha Collections Services, LLC

Frank Stanek vs. Alpha Collections Services, LLC*

According to PACER, on or about August 2013, Alpha Collections Services, LLC began trying to collect a debt from Arizona resident Frank Stanek. He later complained that agency representatives phoned his sister and disclosed private details regarding the alleged debt, and that when he called them back, the company claimed to be pursuing check fraud charges against him.

Scared and confused, Mr. Stanke agreed to some initial payments. These payments continued until he decided to pursue bankruptcy, at which point he advised Alpha Collections Services, LLC that he had an attorney and provided the necessary contact information. Collectors allegedly continued contacting him, saying that he was committing a federal offense by not paying, and claiming they would have him thrown into jail.

Feeling harassed by Alpha Collections Services, LLC, Mr. Stanek hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Discussing the debt with uninvolved third parties
  • Using unfair and unconscionable means to collect a debt
  • Using false, deceptive and misleading means to collect a debt
  • Using oppressive and harassing means to collect a debt
  • Misrepresenting the character, amount, and legal status of the debt
  • Threatening legal action that could not be taken
  • Contacting him directly after being advised that he had an attorney

The matter was later dismissed.
