Brightwater Capital, LLC is a debt collection agency located in Maitland, Florida. It was established in 2010, has less than 10 employees, and is managed by its Vice-President, Liliana Shields. Records on file at the PACER (Public Access to Court Electronic Records) website confirm that Brightwater Capital, LLC has been accused of violating consumer rights during the debt collection process.

Alleged Violations against Brightwater Capital, LLC

According to PACER, in or around 2014 Brightwater Capital, LLC started trying to collect a Citibank debt from an Illinois consumer, who was a disabled senior citizen, with limited assets and income, who fell behind on paying her bills. She sought the assistance of legal aid attorneys at the Chicago Legal Clinic’s LASPD program, who contacted the two companies Brightwater Capital, LLC had retained to collect the debt. Her attorneys advised that the consumer was represented by counsel, and directed that further collections cease because she was forced, by her financial circumstances, to refuse to pay her unsecured debt.

Undeterred, Brightwater Capital, LLC allegedly had yet another debt collector, send the consumer a collection letter in September 2014. She responded by suing the company for allegedly violating the FDCPA in the following ways:

  • Ignoring a cease communication request
  • Contacting her directly after she had engaged an attorney

The matter was later dismissed.

Hello, I keep getting a text message saying I am delinquent on paying my credit card. I called the number provided and they told me it was not a credit card it was a loan I stopped paying on when Covid hit. The man identified himself as Eric and said he was from Brightwater capital and I owed 693.72 on a loan from Sunrise Bank- Signature Health. He gave me an account number and told me to call them to find out about this and I asked for the phone number he said to look it up he didn’t have it and that if I give the account number they will probably tell me that they sold my debt to Brightwater Capital. I said ok and he told me to call him back at a different number I was given in the text and he said he will give me a pay off amount and letter if I just wanted to get this taken care of. With so many scams out there and I tried to find the business and I was unable to find it I am thinking this is just a scam where this person was able to get my last four of my social security, and gave me a fake account number just to scam me out of money. Well I will not be this easy to give away money especially since I don’t remember this and can’t even find the business.
