Are You Being Called By Constar Financial Services, LLC?*

Debt collection abuses are reaching an all-time high. Collection agencies are chasing consumers for debts that don’t belong to them, or for debts that are barred by statute, or for debts which were discharged in an earlier bankruptcy. It’s more important than ever for consumers to understand their rights.

Your Rights Under the FDCPA

While debt collectors are allowed to contact you and make arrangements for you to pay a debt, the Fair Debt Collection Practices Act (FDCPA) prohibits them from using aggressive and unethical actions like the following:

  • Using foul language
  • Trying to collect amounts that exceed the original debt
  • Pretending to be police officers or federal agents
  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m.
  • Threatening legal action they cannot take
  • Contacting you when you are represented by an attorney

Alleged Violations against Constar Financial Services, LLC

According to PACER, on or about November 3, 2016, a Wisconsin consumer received a collection letter from Constar Financial Services, LLC.

It included the text: “This collection agency is licensed by the Division of Banking in the Wisconsin Department of Financial Institutions, wdfi.org. P.O. Box 7876, Madison, Wisconsin 53707.”

An investigation, however, did not yield any evidence that the company held a Wisconsin Collection Agency License.

Feeling harassed by Constar Financial Services, LLC, the consumer hired an attorney and sued the agency for using false, deceptive, and misleading means to collect a debt.

The matter was later dismissed.
