According to PACER, on or around September 2013, Diverse Funding Associates, LLC purchased a Wells Fargo debt and assigned an agent to collect it from a Florida consumer.

The consumer complained that this agent, which allegedly acted under instructions from Diverse Funding Associates, LLC, left voice messages that did not identify the caller as a debt collector, claimed that it had a “demand notice for a federal document that needs to be signed by you” and otherwise made reference to legal action that never transpired.

Feeling harassed by Diverse Funding Associates, LLC, the consumer obtained legal representation and sued the company for allegedly:

  • Using false, deceptive, and misleading means to collect a debt
  • Threatening to take action that could nor legally be taken
  • Failing to identify itself as a debt collector in all communications

The matter was later dismissed.
