Plaintiff vs. Dovuto Collection Services

According to PACER**, in September 2012 a Florida resident received a collection letter from Dovuto Collections Services about a debt she had originally owed to Callahan Family Dentistry.)

She had filed for bankruptcy on March 29, 2012, and this original creditor had received a copy of her petition, which was subsequently discharged on July 25.

When another collection letter followed, The Plaintiff hired a consumer attorney and sued Dovuto Collections Services for violating the FDCPA in the following ways:

  • Communicating with the Plaintiff even though the agency knew she was represented by an attorney
  • Using false, deceptive, or misleading representations or means in connection with the collection of a debt.
  • Falsely representing the character, amount, and/or legal status of the debt.

The matter was later dismissed.
