While debt collectors may legally ask you to pay a debt, they are not allowed to harass and bully you until you pay. In fact, if a collection agency does take things to that extreme, you have the legal right to demand that they stop and sue them if they don’t.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) was passed 40 years ago to stop abusive conduct on the part of third-party collection agencies. Since 1977, collection tactics like the following have been illegal under federal law.

● Using profane and obscene language
● Calling at inconvenient times, usually before 8:00 a.m. and after 9:00 p.m.
● Threatening action they cannot legally take or have no intention of taking
● Telling you that by failing to pay the debt, you have committed a crime
● Demanding amounts that are inflated by ‘service charges’
● Calling you several times per day using an autodialer

The company started in 1966, has 25 employees, and is managed by James King. Archived records at the PACER website show that people who believed they were being harassed by EGS Financial Care, Inc. were not intimidated.

Alleged Violations against EGS Financial Care, Inc.

According to PACER, in or around early 2018, EGS Financial Care, Inc. allegedly started calling a California consumer to collect a debt. She alleged that these calls were made at a harassing rate, and that when she told the collectors to stop contacting her, the request was ignored.
