According to PACER, on or around November 23, 2016, Lloyd & McDaniel, PLC filed a lawsuit against an Arkansas consumer to collect an old credit card debt. The following December, she received a letter from the debt collector chasing the debt, which read, in part,

“The law limits how long you can be sued on a debt. Because of the age of your debt, we will not sue you for it. If you do not pay the debt, we may continue to report it to the credit reporting agencies as unpaid.”

The consumer retained counsel to defend herself and the lawsuit was dismissed because the debt was out of statute.

Feeling harassed by Lloyd & McDaniel, PLC, she hired a consumer attorney and sued the firm for:

  • Using false, deceptive, and misleading means to collect a debt
  • Using harassing and abusive means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later dismissed.
