According to PACER, on or around July 10, 2014, MGC Mortgage, Inc. foreclosed on the home of an Alabama consumer to collect an alleged mortgage debt. He alleged that the foreclosure was illegal because he had invoked loss mitigation procedures allowed under RESPA but the company had refused to cooperate and have him misleading information.

Feeling harassed by MGC Mortgage, Inc., the consumer engaged an attorney and sued the agency for violating the FDCPA by using harassing and abusive means to collect the debt. The matter was later dismissed.
