Thousands of people are pursued by debt collectors who swear at them, embarrass them in front of friends and family, and threaten to ruin their credit. Many of these consumers would be surprised to know that laws exist to protect them from this behavior.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, was passed in 1977 to protect indebted consumers from being abused by third-party debt collectors. This federal law prohibits collection agents from using tactics like the following to stress you into paying:

● Swearing, yelling, and calling you names
● Trying to collect amounts that are not supported by law
● Contacting you directly when they know that you have an attorney
● Threatening to have you arrested
● Telling your friends, neighbors, and co-workers that you owe money
● Calling you at work

Alleged Violations against The Law Offices of Ross Gelfand

According to PACER, in or around early 2011, The Law Offices of Ross Gelfand began calling a New Jersey consumer about a debt allegedly owed to Chase Bank.

During the initial conversation with Plaintiff, a representative allegedly stated that they could work with her for a monthly rate of $200.00 – $250.00. When the consumer replied that she was unemployed, the representative allegedly yelled, ““How are you paying your heat and how is it that you have this phone? Don’t tell me about society and jobs are hard to get!” He also allegedly threatened to take legal action against her if the debt was not paid immediately.

The consumer also complained that the firm contacted her parents-in-law and had detailed discussions regarding her debt with them, causing her a great deal of embarrassment and emotional distress.

Feeling harassed by The Law Offices of Ross Gelfand, she hired a lawyer and sued the firm for:

● Contacting third parties about the debt
● Using abusive language
● Implying that legal action was forthcoming

The matter was later settled.
