Are You Being Called By the Office of Sam Streeter?

When financial emergencies arise, even those who have regularly paid their bills can find themselves overwhelmed by debt, but a previously good payment history doesn’t always matter to debt collectors. Despite the presence of consumer protection laws, they can indulge in abusive behaviors to make you pay.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA prohibits abusive debt collection practices. It regulates what collection agencies may say or do while communicating with consumers and prohibits practices like those below.

● Swearing and calling you names
● Contacting you after you have sent a cease and desist letter
● Calling you outside of the hours of 8:00 a.m. and 9:00 p.m. your time
● Calling you at work when they know that your employer prohibits such calls
● Ignoring a formal request to cease communications
● Threatening to seize your property or garnish your wages

Alleged Violations against the Office of Sam Streeter

According to PACER, on or around February 14, 2008, the Office of Sam Streeter filed a lawsuit against a Texas consumer to collect an arbitration award received by its client in a matter involving a delinquent credit card debt. The award had been made in 2006, however, and her counsel alleged that the original creditor could not seek to confirm the arbitration award under the Federal Arbitration Act, because such a claim was barred by the one-year limitations period.

Feeling harassed by Office of Sam Streeter, the consumer sued the firm for:

● Using unfair and unconscionable means to collect a debt
● Using misleading means to collect a debt

The matter was later settled.
