Alleged Violations against USI Solutions, Inc.

According to PACER, on or around June 3, 2016, an agent of USI Solutions, Inc. sent a collection letter to an Illinois consumer regarding a private student loan that became delinquent in 2006. It stated, in part:

Because of the age of your debt, USI SOLUTIONS, INC. will not sue you for it. If you do not pay the debt, USI SOLUTIONS, INC. may report it …. as unpaid.

The consumer felt that threats to take negative action belied the statement about not intending to sue him. The agency also could not file a delinquent credit report regarding the debt at issue because no such report can be made once seven years have passed from the date of last activity.

Feeling harassed by USI Solutions, Inc., the consumer filed an FDCPA lawsuit against the company for allegedly:

  • Using unfair and unconscionable means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt

The matter was later settled.
